Downer EDI ordered to reinstate and compensate workers at the Boggabri Coal Mine

Mining contractor Downer EDI has been ordered by the Fair Work Commission to reinstate the three workers it sacked from the Boggabri Coal Mine after it was found guilty of conducting unfair dismissals, as flagged by the mining union.

According to the article on Coal Guru, the Commission has also ordered Downer EDI to compensate the workers for lost wages — a move which was welcomed by Mr Peter Jordan, the Construction, Forestry, Mining and Energy Union (CFMEU) District President, who said the decision validated the Union’s arguments.

“This decision is a kick in the guts to Downer, because everything that was said to them, they ignored. They were arrogant and steadfast throughout the entire process, refused to negotiate, refused to consider about reaching some compromise arrangement and now they’re confronted with a decision that was all in favour of the workers,” he said.

He said he hoped the decision would make Downer reconsider its plans to hire 457 visa workers over locals.

“They’ve made applications on a number of occasions to bring 457 Visa workers into Australian mining jobs.”
